Terms of Service

1. Acceptance

By creating a Buytena account you agree to these terms. If you do not agree, do not use the service.

2. Your account

You are responsible for the security of your account, for keeping your password safe, and for activity that happens under your account. You agree to provide accurate business information and to keep your customer list lawful.

3. Acceptable use

You may not use Buytena to send unsolicited marketing messages, to send content that violates local laws, or to impersonate another person. You are responsible for collecting any consent required by law to contact the customers you upload.

4. Customer data

You retain all rights to the customer data you upload. You grant us a limited license to process that data solely to operate the service. We process it on your behalf under our Data Processing Addendum.

5. Plans and billing

Plans are billed monthly or annually in TZS. Free trials do not require a card. You can cancel any time and continue to use the service until the end of the current period. Refunds are not provided for partial periods except where required by law.

6. Service level

We aim for 99.9% uptime on Growth and Enterprise plans. Starter has best-effort availability. We do not guarantee SMS or WhatsApp delivery by third-party telecoms, but we retry failed messages and surface delivery state in the dashboard.

7. Suspension

We may suspend your account if you breach these terms, fail to pay, or use the service in a way that puts other customers at risk. We will try to give you reasonable notice first.

8. Disclaimers and liability

Buytena is provided as-is. To the maximum extent allowed by law, we exclude indirect, incidental, and consequential damages. Our total liability is capped at the amount you paid us in the 12 months before the claim.

9. Changes

We may update these terms. Material changes will be emailed and announced in the dashboard at least 14 days before they take effect.

10. Governing law

These terms are governed by the laws of the United Republic of Tanzania. Disputes are resolved in the courts of Dar es Salaam.
